Edge Servers Acceptable Uses Policy & Service Guidelines
Cutting
Edge Servers provides shared web hosting to many clients and
has a responsibility to protect each client and to provide
the best services available. The following guidelines were
designed to ensure that these obligations are met.
Content
All
services provided by Cutting Edge Servers may be used for
lawful purposes only. Transmission, storage or presentation
of any information, data or material in violation of any United
States Federal, State or City law is prohibited. This includes,
but is not limited to, copyrighted material, material we judge
to be threatening or obscene or material protected by trade
secret or other statute. The subscriber agrees to indemnify
and hold harmless Cutting Edge Servers from any claims resulting
from the use of the service that damages the subscriber or
any other party.
All pornographic content and sex-related merchandising is
prohibited on all Cutting Edge Servers servers. This includes
sites that may infer sexual content or links to adult content
elsewhere. Cutting Edge Servers will be the sole arbiter in
determining violations of this provision.
Also prohibited are sites that promote any illegal activity
or present content that may be damaging to Cutting Edge Servers
servers or any other server on the Internet. Links to such
materials are also prohibited.
Examples
of unacceptable content, links and/or use:
- Pirated
software
- Hacker
programs or archives
- Warez
sites
- Sending
of Unsolicited email
- IRC
bots or software
- Pornography
- Virus
infected software or email
- Violating
U.S. export restrictions
- Threats
- Stalking
- Illegal
activity
- Theft
- Sharing
copyrighted MP3, music or video files
- Violation
of the DMCA
- Copyright
infringement of any kind
Cutting
Edge Servers will be the sole arbiter as to what constitutes
a violation of this provision.
Commercial Advertising - E-mail
Spamming,
or the sending of unsolicited e-mail, from an Cutting Edge
Servers server or using an e-mail address or domain that is
maintained on an Cutting Edge Servers machine as reference
is STRICTLY prohibited. Cutting Edge Servers will be the sole
arbiter as to what constitutes a violation of this provision.
IRC
IRC
or IRC bots may not be operated on our servers at this time.
Liability
If
for any reason, your website becomes inaccessible, damaged
or otherwise, Cutting Edge Servers is not liable for any damages,
loss if income, wages or customers.
The
customer is solely responsible for all material on their website.
We
will not tolerate any unacceptable uses of our servers and
will terminate accounts at will and at our own sole discression
if we believe your account is being used in any way that may
conflict with this agreement.
The
client is responsible for their own website content. If the
content is lost, it is the sole responsibility of the client
to restore the lost content.
If
data is lost and cannot be recovered. Cutting Edge Servers
will attempt to recover lost data from our own archives, but
we do not guarantee that your files will be recovered. We
consider this a "last resort".
We
may modify this agreement at anytime with or without notifying
the clients and customers. If the client violates this agreement
in any way, at anytime, Cutting Edge Servers reserves the
right to completely remove the account from our systems.
Server Abuse
Any
attempt to undermine or cause harm to a server or customer
of Cutting Edge Servers is strictly prohibited.
Refusal of Service
We
reserve the right to refuse, cancel or suspend service based
on any violation of the above stated policy and guidelines.
All
Sub-Networks, distributive hosting sites and dedicated servers
of Cutting Edge Servers must adhere to the above policies.
Failure to follow any term or condition will be
grounds for immediate account deactivation.
